Terms of Service
These Terms govern your use of Mayday Control (the "Game"), operated by Juan Fernando Juliao, an individual (sole proprietor) ("we", "us"), 6624 Hitchingpost Ln, Cincinnati, OH 45230. Contact: support@maydaycontrol.com. By creating an account or playing, you agree to these Terms and the Privacy Policy.
1. Eligibility and parental consent
You must be at least 13 years old to create an account or play the Game. If you are between the ages of 13 and 17, you may only use our services if your parent or legal guardian reviews and agrees to these Terms together with you. By permitting a minor to use the Game, the parent or guardian accepts these Terms and agrees to be jointly and severally liable for all actions taken on the account, including any in-game purchases, chats, or behavioral violations. We do not knowingly allow anyone under the age of 13 to create an account or provide personal data. We may suspend or terminate accounts that we believe are being used without the required parental permission.
2. Your account
Keep your password private. You are responsible for activity on your account. Give accurate information, including your date of birth. We may suspend accounts that break these Terms.
3. Free and paid play
Every level (Quick Start, Easy, Medium and Hard) includes one free game for each account. After that, playing requires a yearly membership. The membership is $29.99 per year (US dollars) and is billed once a year; there is no monthly plan.
Classes. Instructors approved by us can create classes for teaching. While a class has not ended, its students and instructor have free play on every level. Class access ends on the end date the instructor sets, or earlier if the instructor removes you or you leave the class. After it ends, normal rules apply. We may withdraw class access for misuse.
4. Automatic renewal
Membership renews automatically each year at the then-current price unless you cancel before the renewal date. You can cancel any time from the Manage membership button on your account page; you keep access until the end of the period you paid for. We do not send renewal reminder emails. You are responsible for keeping track of your renewal date, which is shown on your account page. See Refunds.
5. Payments
Payments are handled by Stripe. We never see or store your card number. Taxes may apply where required.
6. Acceptable use
Do not cheat, reverse-engineer, attack or overload the service, access other people's accounts, or harass others. Do not use the Game to break the law.
Online rooms and chat. Room chat is text only. Do not post links, advertising or spam, and do not post threats, hateful, sexual or harassing content, or anyone's personal information. Other players can mute, block or report you. We may review reported messages, silence or remove your chat access, and close accounts that break these rules. Chat messages are kept for about 30 days; reports and what we decided are kept longer for safety. Players under 18 can chat only in private (invite-only) rooms.
7. Game money is not real money
In the Game, amounts shown in US dollars (such as "wins", revenue, costs and cash) are only a way of keeping score. The Game does not use real money. You cannot deposit, wager, win, cash out or exchange anything of real-world value, and nothing in the Game is gambling. The dollar amounts are a representation only and must not be confused with real money.
8. Tournaments
We plan to hold Mayday Control tournaments from time to time, currently intended to be about once a quarter. We have not yet announced dates, rules, entry fees or format, and we may change, postpone or cancel any tournament. Any entry fee, eligibility rule and the way results are decided will be published before a tournament opens, and by entering you agree to those rules in addition to these Terms. Tournaments offer recognition only; unless we clearly state otherwise in the announcement, no prize of money or other real-world value is offered. Tournament results may be shown publicly using your username. We may disqualify an entry and remove its result if we believe the rules or these Terms were broken, including by cheating or tampering with the Game. Section 7 applies: game dollars are not real money and nothing in a tournament is gambling. You must meet the eligibility and parental consent requirements in Section 1 to enter.
9. Our content
The Game, its rules, art, audio and code belong to us or our licensors (see Credits & licenses). You may play for personal, non-commercial use. Mayday Control is a game; it is not flight, maintenance or safety training and must not be used as such.
10. Availability and changes
We try to keep the Game running but do not promise uninterrupted service. We may change features or these Terms; if changes are material we will tell you, and continued use means you accept them.
11. Disclaimers and liability
The Game is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim.
12. Governing law
These Terms are governed by the laws of Ohio, USA, without regard to conflict-of-law rules.
13. Text-message alerts
Text alerts are optional. If you enter a US mobile number on your account page, tick the box and confirm the code we text you, you agree to receive automated text messages from Mayday Control at that number about your games: a confirmation code, when it is your turn, when players join your game and when your game starts. We send at most 8 alert texts a day, and not between 9 pm and 8 am where you are. Consent is not a condition of playing or buying anything. Message and data rates may apply. Reply STOP to any text to cancel, or HELP for help, or turn alerts off on your account page. Text alerts are for players 18 and over. Carriers are not liable for delayed or undelivered messages, and we may stop sending texts at any time.
